Copyright & DMCA Policy

1. Overview

OnlyFunds (Foxxx Fitzwell Entertainment LLC, DBA OnlyFunds) respects the intellectual-property rights of others and expects its customers to do the same. This policy describes how to notify us of claimed copyright infringement in connection with the Services, and how we respond, consistent with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.

It is our policy to (a) respond to clear notices of alleged copyright infringement that comply with the DMCA, and (b) in appropriate circumstances, disable or terminate the accounts of customers who are repeat infringers.

2. Designated Copyright Agent

Note: to preserve DMCA safe-harbor protection, this designated agent must also be registered with the U.S. Copyright Office (dmca.copyright.gov). Keep the registration current.

3. Filing a DMCA Notice of Infringement

If you believe material accessible through the Services infringes your copyright, please send a written notice to our designated agent that includes all of the following (as required by 17 U.S.C. § 512(c)(3)):

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
• Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works).
• Identification of the material claimed to be infringing, and information reasonably sufficient to let us locate it (for example, a URL or a specific description).
• Your contact information — name, address, telephone number, and email address.
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages.

4. Our Response

Upon receiving a valid DMCA notice, we will act expeditiously to remove or disable access to the material identified, and we may notify the affected customer. We may also forward the notice to the customer who provided the material.

5. Counter-Notification

If you are a customer whose material has been removed and you believe it was removed in error or misidentification, you may send a written counter-notification to our designated agent that includes all of the following (as required by 17 U.S.C. § 512(g)(3)):

• Your physical or electronic signature.
• Identification of the material that was removed and the location where it appeared before removal.
• A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the U.S. federal district court for your address (or, if outside the U.S., for any district in which we may be found), and that you will accept service of process from the person who submitted the original notice or their agent.

If we receive a valid counter-notification, we may restore the material in 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

6. Repeat Infringers

In appropriate circumstances and at our discretion, we will disable or terminate the accounts of customers who are found to be repeat infringers, consistent with 17 U.S.C. § 512(i).
